The key word in your post is 'purely', that old adage about everything being political may have some people asking why the courts are involved at all. I guess the answer is that Parliamentary procedure is involved as well and that if it has been abused for the advancement of factional aims then are further sanctions required? | |

They are hearing on both the Scottish Court ruling against the Government, and Gina Miller's Appeal against her defeat under English Law. And apparently (and I say this as somebody who isn't an expert on 17th Century Scottish Constitutional precedent founded in the Claim of Right Act 1689) there is a difference in the wording in Scottish Law as opposed to English Law, of the expectation on the Monarch to allow or cause Parliament to sit. Which is why the Scottish Judges ruled as they did. The argument is a technical one over whether it was 'a matter of high policy and political judgment', in which case it is up to the government when and why they ask for a prorogation, as long as they follow the procedural rules (which they have) or whether it was not, is justiciable and therefore comes down to the government's motivation for so advising the Queen (and any discrepancy between public and private intentions). Also, indeed, whether that discrepancy and the secret motives of the government (to stymie Parliament and prevent scruitiny of the executive) revealed in the documentary evidence is enough to place it within the remit of the courts - which is what the Scottish judges decided the other day (but operating under Scots law, not English). That is slightly weird with the polling. I do wonder if their statistical modelling is too heavily weighted towards Con and Lab, which would have been entirely reasonable a few years ago but has possibly now been upset by the SNP, the resurgent LibDems and the Brexit Party. In 2017, most polling significantly overrated the Conservatives, underrated Labour and the others. | |
